DMCA Policy – Nicorner

1) Purpose

Nicorner respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We may (a) remove or disable access to material that we in good faith believe infringes copyright and (b) suspend or terminate services for repeat infringers. Your use of our services remains subject to our Terms of Service, which incorporate this policy. Capitalized terms not defined here have the meanings given in the Terms of Service.


2) How to Send a DMCA Takedown Notice

If you believe content hosted on, displayed by, or accessible through Nicorner infringes your copyright, send a written notice to our Designated Agent that includes all items below (17 U.S.C. §512(c)(3)):

  1. Signature – A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

  2. Work Identified – Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works at a single online location).

  3. Location of Infringing Material – Identification of the material alleged to be infringing and information reasonably sufficient to permit us to locate it (e.g., specific URLs, product pages, screenshots).

  4. Good-Faith Statement – A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

  5. Contact Information – Your name, postal address, telephone number, and email address (if available).

  6. Accuracy & Authority – A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that do not contain the required elements may be invalid or delayed.


3) What We Do After Receiving a Proper Notice

Upon receipt of a compliant notice, Nicorner may:

  • Remove or disable access to the identified material;

  • Notify the uploader or account holder that the content has been removed or disabled; and

  • Apply our repeat-infringer policy, which may include suspension or termination.

We may retain copies of your notice for recordkeeping.


4) How to Send a Counter-Notice (If Your Content Was Removed)

If you believe the material was removed or disabled due to mistake or misidentification, you may submit a Counter-Notice to our Designated Agent containing:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed or disabled and the location where it appeared before removal.

  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, postal address, telephone number, and email address.

  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district of your address (or, if outside the U.S., any judicial district in which Nicorner may be found) and that you will accept service of process from the person who filed the original notice or that person’s agent.

After receiving a valid Counter-Notice, we may forward it to the original complainant. Unless the complainant informs us that they have filed an action seeking a court order to restrain the allegedly infringing activity, Nicorner may restore the removed material or cease disabling access within 10–14 business days, at our discretion.


5) Repeat-Infringer Policy

Accounts that receive multiple valid infringement notices may be deemed repeat infringers. Nicorner may limit, suspend, or terminate access to services for repeat infringers as appropriate.


6) Misrepresentations

Submitting false or bad-faith notices or counter-notices may expose you to liability, including costs and attorneys’ fees (17 U.S.C. §512(f)). If you are unsure about your rights, consider consulting a legal professional before filing.
